Charles absolute Lord and Prop.ry of this Provinces of Maryland & Avalon
Lord Baron Baltemore &c. To all persons to whom these presents shall Come greeting
in our Lord God everlasting. Know yee that for & in consideration that John Bayley of
Charles County Planter hath due unto him One hundred Eight Seven Acres of Land
within this our said Province of Maryland by assignment from Capt. Randolph Brandt
of the same County Assigned of John Addison of St. Maries County Gent. Honorable of
Thomas Dent late of the said County of St. Maries Deceased part of a warrt for Twelve
hundred Acres granted to the said Dent the One and twentieth day of June Anno One
thousand six hundred seventy and five as appears upon Record and upon Such Conditions &
terms as are expressed in the Conditions of plantation of our late Father Cecilius &c. of
noble memory according to his Declaration bearing date the two and twentieth day of
September Anno One thousand Six hundred fifty eight with such allocations as in
them is made by his instructions to us bearing date the Eight & twentieth day of
July One thousand Six hundred Sixty Ninth and the One & twentieth day of March
then next following All doing & remaining upon Record in our said Province
of Maryland Wee do hereby grant unto him the said John Bayley All that tractor
parcell of land lying in Charles County aforesaid called Bayleys Rest beginning at a
bounded Chestnut Oak standing near the Clift by a path running toward North sixty
perches to a bounded Locust post thence East five hundred perches to a bound Hickory
Thence South sixth perches to a bounded White Oak. Thence west to the first bound tree
Containing One hundred Eighty and Seven Acres more or less and bounds on North
and South with two severall tracts of Land belonging to John Pope. On the west with
Potomack River on the East with the Lands of John Clark according to the Certificate
of Survey there of taken and returned into our Office for Lands at our Citty of St. Maries
bearing date the fourth day of this Instant August and remaining upon Record in our
said Office together with all Rights proffits and benefits there unto belonging (Royall Mines
excepted) to have & to hold the same unto him the said John Bayley his heirs and
Assigned forever to beholden of us and our heirs as of Manr of Zachiah in free
and Common Soccage by fealty only for all manner of Services Yielding & paying
therefore yearly unto us and our heirs at our Receipt at our citty of St. Maries at the two
most usuall feasts in the year vizt at the feast of the Annunciation of the Blessed Virgin
Mary and at the feast of St. Michael the Archangell by even and equall portion the Rent
Seven Shillings & five pence half penny sterl[ing] in Silver or Gold And for a fine upon every
alienation of the said Land or any part or parcel thereof One whole year of Rent in Silver or Gold
or the full value thereof in such Condition as Wee or our heirs or such Officer or Officers
as shall be appointed by us or our Heirs from time to time to collect & receive the same shall
accept in discharge thereof at the choice of us and our heirs or such Officer or Officers as aforesaid
Provided the if the said sum for a time for alienation shall not be paid unto us & our heirs or
such Officer or Officers as aforesaid and the said alienation entred upon Record either in the
Provincial Court or in the County Court where the said parcell of Land lyeth within one month next
after such alienation the said alienation shall be void and of no Effect Given at our Citty of St.
Maires under the great Seal of our said Province of Maryland this Seventeenth day of August in
the fifth year of our Dominion &c. Annoque Domi One thousand Six hundred & Eighty Witness our self.

Registers Office } Wilkes County
In the name of God Amen. I, JAMES BAILEY, of the County of Wilkes, being in perfect
health of body and perfect mind & memory thanks be to God. Calling unto mind the mortality of my
body, knowing that it is appointed for all men once to die, do make and ordain this my last Will &
Testament and as touching such worldly estate whereas it has pleased God to bless me with in
this life, I give, devise and dispose of the same in the following manner and form.

FIRST, I give and bequeath to LITTISHA, my beloved wife, the plantation and tract of land
whereon I now reside containing two hundred & fifty acres, more or less, being what is the west
side of my spring branch and a new line up to a corner white oak being Azariah Bailey Line,
together with all my personal estate during her natural life and at her decease, I give the above
mentioned plantation and tract of land to my son, JOHN GUINN BAILEY, to his assigns and his
heirs forever.

Also, I give to my son, JAMES BAILEY, a tract of land containing two hundred acres
according to a grant the same lying on the west side of the above mentioned tract, to him and his
heirs forever, and at the decease of my wife, I leave the whole of my personal estate to be sold
and equally divided between all my children to-wit: AZARIAH [BAILEY], JAMES BAILEY,
JOSEPH BAILEY, JOHN GWINN BAILEY, MARY BOSTICK, LITTISHA [STREET], and
ANN JONES.

I, likewise constitute, make and ordain AZARIAH BAILEY and JOHN GWINN BAILEY,
executors of this my last Will and Testament, and revoking all former one’s. In Witness whereof,
I have hereunto set my hand and seal this thirty-first day of January in the year of our Lord one
thousand seven hundred and ninety-five.

presents that I Richard Wheeler of the County and State afore
Said, being in perfect mind and memory and knowing
the uncertainty of Life do make Constitute and ordain this
my last Will and Testament In the name of God

Item 1st. I give and bequeath to my wife Margret Wheeler
all my Estate real and personal dureing her natural
life. ~
Item 2nd. I give and bequeath to my son Drummond Wheeler one
negrow boy by the name of George one bed and furniture ~
Item 3rd. I give and bequeath to my daughter Nancy Neil
Green one negrow girl and her increase by the name of hannah
Item 4th. I give and bequeath to my Son Benjamin Neil Wheeler
one negrow boy by the name of Daniel and one negrow girl by the
name of Elizabeth to him and his heirs lawfully begotten ~
Item 5th. I give and bequeath to my son Nimrod Bates Wheeler
one negrow Girl by the name of Winefred and one negrow boy
by the name of Zachariah to him and his heirs lawfully begotten
Item 6th I give and bequeath to my Daughter Lucinda one
negrow Girl by the name of Alse and her future increase
to to her and her heirs ~
Item 7th I leave my negrow Girl Rachel to a free Choice to
live with any of my children after the death of my wife
and myself and if said Rachel Should have Children the
first I bequeath to my Grandaughter Margret Sandford
Green and if said Rachel should have two it is my will
that my grandaughter Eliza Jane Neil Wheeler have the youngest
of the Two first ~

Testament of Azariah Bailey

State of Georgia In the name of Almighty God,
Newton County Amen

I, AZARIAH BAILEY, being low in health, but of sound disposing mind and memory, do
make, declare and publish this my last Will & Testament.

FIRST, I commend my feeble body to the dust whence it came and my soul to the hands
of my Creator.

In making a disposition of such worldly effects as I have, it is my will and desire FIRST.
The tract of land upon which I now reside, being part of those lots I give JOSHUA BAILEY,
JOSEPH BAILEY and EPHRIAM HEARD and to their heirs to be divided or sold as a majority of
them may deem proper.

SECOND, the lot of land I hold in the County of Henry Number / 122 / one hundred &
twenty-two and the Sixth District, I give to the legal representatives of WILLIAM BAILEY,
deceased, and to the legal representatives of CALEB BAILEY, deceased, to be equally divided
by my executors hereinafter named.

THIRD, I give to BENJAMIN H. BAILEY and his heirs the tract or half of lot of land
whereon WILLIAM HUBBARD now resides.

FOURTH, I give to my son JOSHUA BAILEY and his heirs the following Negroes, to-wit:
Little Anthony, Eady, Stephen, Peter, and Celia, and their issue.

FIFTH, I give to my son JOSEPH BAILEY four hundred dollars in consideration of his
having relinquished his claim to a certain Negro named Big Anthony which said sum of four
hundred dollars is to be paid by my after named executors as soon as they conveniently can. I
hold some notes made by Thomas Fields and Joseph Howard which I wish to be disposed of
as follows: First I wish all my just debts / if any / immediately paid. To my grandson, JESSE H.
BAILEY, the sum of one hundred & thirty dollars when he arrives at the age of twenty one years
which is to remain in the hands of BENJAMIN H. BAILEY on his making the same secure to the
said JESSE H. BAILEY when due, which is not to bear interest while in such safe keeping. I give
to my grandchildren, JESSE, WILLIAM, AZARIAH, ELIZABETH and JOHN BAILEY, children of my
son, CALEB BAILEY, deceased, the sum of one hundred dollars to be in the hands of my son,
JOSHUA. The balance of the above named notes, if any, together with the residue of my
personal property I wish to be divided into six equal shares and amongst the legal heirs of
WILLIAM BAILEY, deceased; EPHRIAM HEARD; JOSHUA BAILEY; the legal heirs of CALEB
BAILEY, deceased; JOSEPH BAILEY; and BENJAMIN H. BAILEY.

Having paid to my son, JOSEPH, the most of the four hundred dollars in this will
specified for the Negro, Big Anthony, I wish my after named executors to come to settlement with
said son, JOSEPH, and pay the balance of the said four hundred dollars to him.

I hereby nominate and appoint my sons, JOSHUA BAILEY and BENJAMIN H. BAILEY,
executors to this my last Will & Testament hereby revoking & canceling all other & former Wills
by me made.

In testimony whereof, I have hereunto set my hand and seal the 19th day of October, 1831.

Georgia Court of Ordinary March 5th, 1832. In open court
Newton County personally appeared Zachariah B. Hargrove, Jesse W.
Morrow, James Hodge Jr., and after being duly sworn saith that they saw the within named
AZARIAH BAILEY, deceased, sign and seal and publish the within as his last Will & Testament
and they further swear that at the time of such sealing, signing & publication that the said
AZARIAH was in his proper senses and of sound and disposing mind, according to the best of
their knowledge and belief.

I Margarett Wheeler being week in boddy but of Sound and
perfect mind and memory doe make and
publish this my last will and Testament in manner
and form following first I gave and bequeath unto
the heirs of my son Drummond Wheeler Deceast the
Sum of sixty dollars to be made out of my personal
property which Proproperty the Executor that I hereafter
Shall appoint will Take in possession after my
death and make Sale of as the Law prescribes and the
money arang from the Sale or Sales of all the personal
property which I possess at my death I will that all
Just debts that may come against my Estate be paid
if any thare be and that the above Sum of Sixty dollars
be paid to the heirs of my Son Drummond Wheeler
descd and the Balance of the money arising from the
Sales of the property Soe left after my death I doe
gave and bequeath the Sum of Ten dollars to
Nimrod B Wheeler guardian of Lucinda Green
a minor for the Sole use and benefit of the Said
minor now living with me & I further bequeath
my Executor hereafter named the Sum of Twenty
five dollars for his servises as Executor of this my
last will and the residue of the money I will it
to be by my Said Executor Equally derided between
my children that is to Say Benjm N Wheeler and
Equal part and Nimrod B Wheeler one Equeal
part the heirs of Drummond Wheeler deceased
one Equeal part and my Daughter Lucinda Sharp
one Equeal part & the heirs of my Daughter Nancy
Green decesed one Equal part which said Legacies
in sum of money I will and order Shall be
paid to the said Legatees so soon as Sales &
Collections can be mad after my death the
before mentioned Ten dollars which I will paid
to Nimrod B Wheeler Guardian of Lucinda Green
minor child now living with me I will that
sum to remain in the hands of the Said Nimrod
B Wheeler as guardian aforesaid for the Sole
use and benefit of the aforesaid Minor
Lucinda Green & by the Said guardian to
be paid over with its lawful interest to the
said minor Lucinda Green when She Should
become of lawful age and lastly I due by

hereby Revoking all former wills by me made

This day herein open court the last will and Testament
of Margarett Wheeler widow and relict of
Richard Wheeler late of of this county was
presented for probate whereupon came Abraham
Hayter a Subscribing witness thereto & made
oath that he Saw the Said Margaret Wheeler Sign
Seal or publish and declare this to be her last
will & testament and that She was at the time
of Signing Sealing publishing & declaring
the same of sound mind and memory to the
best of his knowledge and whereas Francis
Starr the other Subscribing witness had heretofore
departed this life and upon that suggestion
came Col Joseph Hart and proved the hand
writing of the Said Francis Starr was then
admitted to record and ordered to be
recorded in will & inventory Book at length
witness my hand at office this 3rd day of August
1840

Nimrod Bates Wheeler c. 1850. This photo is tagged as Louis Belin in ancestry.com by Peggy Ederington but after communicating with Peggy we agreed this must be Nimrod Bates Wheeler. One reason is that one of Louis Belin's arms was amputated on 26 Sept 1844. Peggy Ederington family records do not have the corresponding photo of Kitty Wheeler.
