Randolph Brandt of the same County Assigned of John Addison of St. Maries County Gent. Honorable of Thomas Dent late of the said County of St. Maries Deceased part of a warrt for Twelve hundred Acres granted to the said Dent the One and twentieth day of June Anno One thousand six hundred seventy and five as appears upon Record and upon Such Conditions & terms as are expressed in the Conditions of plantation of our late Father Cecilius &c. of noble memory according to his Declaration bearing date the two and twentieth day of September Anno One thousand Six hundred fifty eight with such allocations as in them is made by his instructions to us bearing date the Eight & twentieth day of July One thousand Six hundred Sixty Ninth and the One & twentieth day of March then next following All doing & remaining upon Record in our said Province of Maryland Wee do hereby grant unto him the said John Bayley All that tractor parcell of land lying in Charles County aforesaid called Bayleys Rest beginning at a bounded Chestnut Oak standing near the Clift by a path running toward North sixty perches to a bounded Locust post thence East five hundred perches to a bound Hickory Thence South sixth perches to a bounded White Oak. Thence west to the first bound tree Containing One hundred Eighty and Seven Acres more or less and bounds on North and South with two severall tracts of Land belonging to John Pope. On the west with Potomack River on the East with the Lands of John Clark according to the Certificate of Survey there of taken and returned into our Office for Lands at our Citty of St. Maries bearing date the fourth day of this Instant August and remaining upon Record in our said Office together with all Rights proffits and benefits there unto belonging (Royall Mines excepted) to have & to hold the same unto him the said John Bayley his heirs and Assigned forever to beholden of us and our heirs as of Manr of Zachiah in free and Common Soccage by fealty only for all manner of Services Yielding & paying therefore yearly unto us and our heirs at our Receipt at our citty of St. Maries at the two most usuall feasts in the year vizt at the feast of the Annunciation of the Blessed Virgin Mary and at the feast of St. Michael the Archangell by even and equall portion the Rent Seven Shillings & five pence half penny sterl[ing] in Silver or Gold And for a fine upon every alienation of the said Land or any part or parcel thereof One whole year of Rent in Silver or Gold or the full value thereof in such Condition as Wee or our heirs or such Officer or Officers as shall be appointed by us or our Heirs from time to time to collect & receive the same shall accept in discharge thereof at the choice of us and our heirs or such Officer or Officers as aforesaid Provided the if the said sum for a time for alienation shall not be paid unto us & our heirs or such Officer or Officers as aforesaid and the said alienation entred upon Record either in the Provincial Court or in the County Court where the said parcell of Land lyeth within one month next after such alienation the said alienation shall be void and of no Effect Given at our Citty of St. Maires under the great Seal of our said Province of Maryland this Seventeenth day of August in the fifth year of our Dominion &c. I, JAMES BAILEY, of the County of Wilkes, being in perfect health of body and perfect mind & memory thanks be to God. Calling unto mind the mortality of my body, knowing that it is appointed for all men once to die, do make and ordain this my last Will & Testament and as touching such worldly estate whereas it has pleased God to bless me with in this life, I give, devise and dispose of the same in the following manner and form. FIRST, I give and bequeath to LITTISHA, my beloved wife, the plantation and tract of land whereon I now reside containing two hundred & fifty acres, more or less, being what is the west side of my spring branch and a new line up to a corner white oak being Azariah Bailey Line, together with all my personal estate during her natural life and at her decease, I give the above mentioned plantation and tract of land to my son, JOHN GUINN BAILEY, to his assigns and his heirs forever. Transcription: Testament of Azariah Bailey State of Georgia In the name of Almighty God, Newton County Amen I, AZARIAH BAILEY, being low in health, but of sound disposing mind and memory, do make, declare and publish this my last Will & Testament. FIRST, I commend my feeble body to the dust whence it came and my soul to the hands of my Creator. In making a disposition of such worldly effects as I have, it is my will and desire FIRST. The tract of land upon which I now reside, being part of those lots I give JOSHUA BAILEY, JOSEPH BAILEY and EPHRIAM HEARD and to their heirs to be divided or sold as a majority of them may deem proper. SECOND, the lot of land I hold in the County of Henry Number / 122 / one hundred & twenty-two and the Sixth District, I give to the legal representatives of WILLIAM BAILEY, deceased, and to the legal representatives of CALEB BAILEY, deceased, to be equally divided by my executors hereinafter named. THIRD, I give to BENJAMIN H. BAILEY and his heirs the tract or half of lot of land whereon WILLIAM HUBBARD now resides. FOURTH, I give to my son JOSHUA BAILEY and his heirs the following Negroes, to-wit: Little Anthony, Eady, Stephen, Peter, and Celia, and their issue. FIFTH, I give to my son JOSEPH BAILEY four hundred dollars in consideration of his having relinquished his claim to a certain Negro named Big Anthony which said sum of four hundred dollars is to be paid by my after named executors as soon as they conveniently can. I hold some notes made by Thomas Fields and Joseph Howard which I wish to be disposed of as follows: First I wish all my just debts / if any / immediately paid. To my grandson, JESSE H. It seems unlikely that the mother was actually Anna Lehnarz since there is only a few days over 9 months for Anna to have died, William to have married, and have a child by his new wife. It is possible someone noticed a possible impediment to the marriage, so they got the dispensation after the fact.
